ALUMAST ONLINE SHOP REGULATIONS

|
Due to article 8 paragraph 1 of the bill concerning electronic services (Official Legal Gazette 02.144.1204 with later changes) ALUMAST joint stock company establishes Online Shop Regulations.

I. GENERAL RULES
|
- Definitions:
- "Purchaser" - a natural person with full legal abilities, registered for a constant or temporary residence in Poland, a legal person or an organizational unit without a legal entity with headquarters in Poland possessing abilities to admit liabilities, being the party in the sales contract,
- "Consumer" - a natural person entering a sales contract not connected directly with his/her economic or professional dealings,
- "Price list" - a list of products offered by the Seller at the ALUMAST online shop including sales prices with the proviso that the above mentioned list is not a sales offer as defined in article 543 of the civil code. The prices are presented in Polish zloty (PLN) and include VAT,
- "Order form" ("Form") – a document establishing the purchaser’s data (name, surname, place of residence, adequately - a company, place, an object of purchase (product marking) and means of direct contract whose filling out is necessary to enter the sales contract. The way of form submission is ruled by regulations,
- "Seller" - ALUMAST joint stock company with its headquarters in Wodzisław Śląski at Marklowicka Street 30a, registered in Business Records conducted by the District Court in Gliwice, X Department of the Country Court Records under the number 0000031909.
- Herein regulations rule the principles and conditions of goods and services sales offered within the ALUMAST Online Shop.

II. ENTERING INTO A CONTRACT
|
- Entering into a sales contract is done by the following activities:
- Purchaser’s sending of a correctly filled out form to the address www.maszty.com.pl.
- Seller’s sales contract confirmation.
- The sales contract is entered when the confirmation mentioned in point II.1.2. has been admitted, the date of the entering, however, is the date of sending the form mentioned in point II.1.1.
- Forms sent by Purchaser on Saturdays, Sundays and holidays will be examined for the adoption by the Seller on the first working day following the above mentioned days.
- Seller may refuse to enter into a contract in case of an improperly filled form, especially if the data given in the form is unreal or incomplete.
- In case of the sales contract refusal, Seller immediately informs Purchaser.

III. PAYMENTS
|
- Payment of the price for the acquired goods may be conducted on the basis of one of the following ways:
- cash on delivery of a parcel – payment made to a courier at the delivery
- credit card or electronic transfer - on-line authorization based on full coding of the connection

IV. DELIVERY
|
- Delivery of goods will be forwarded to the address pointed at the form by the courier company within 48 hours. In case of stock shortages or accidents the delivery may delay by 14 days. This will depend on the form of the payment chosen by the Purchaser:
- form confirmation – payment mentioned in point III.1.A.
- transaction fulfilled – payment mentioned in point III.1.B.
- Purchaser pays the cost of the delivery.
- Purchaser confirms receipt of the delivery on a bill of lading and a VAT invoice. Seller will attach all necessary documents to the goods. At the time of confirmation of receipt of the delivery the right of the possession and the risk related to the possession, operation and especially the risk of loss or damage of the goods are transferred to Purchaser.
- Deliveries are carried out only during working days.

V. DUTIES AND RESPONSIBILITY
|
- Seller will do his best to reach the highest level of services and feels obliged to keep the correspondence data in secret as well as to take actions to protect the server against unauthorized access.
- Seller feels obliged to protect the personal data due to the personal data protection bill and the electronic services bill.
- Purchaser is obliged to use the electronic services according to the legal regulations applied in Poland, provisions of the herein regulations and especially not to place any illegal texts to www.maszty.com.pl and sklep@maszty.com.pl or alumast.com.pl and sklep@alumast.com.pl.
- Seller is not responsible for:
- either the way in which Purchaser is using web pages or any consequences resulting from it;
- the speed of data transfer resulting from the technical limitations and types of transmission connections;
- the lack of transmission or data errors resulting from the discrepancy in technical devices or software used by Purchaser, especially in the field of improper settings of purchaser’s monitor parameters resulting, for instance, in erroneous admission of the appearance of the acquired goods.

VI. WARRANTY
|
- Seller issues Purchasers a warranty for its goods. A warranty card including the detailed rights and duties of parties will be attached to goods.
- Purchaser accepts the date of dealing with a complaint is 21 days after the Seller’s reception.
- Purchaser is obliged to make a complaint concerning the mechanical damages resulted from the transport to the courier at the reception of goods. Otherwise he/she may lose the right of complaint. Purchaser is obliged to demand the courier make a Complaint Protocol.
- Goods, not warranted by Seller, may use a legal status of:
- discrepancy in contracted goods - in case of a Consumer
- guarantee – in case of other Purchasers
- In case of Consumers who acquired the goods embraced by the warranty, the warranty issued by Seller does not exclude, limit or suspends Consumer rights resulting from the discrepancy in contracted goods.

VII. WITHDRAWAL FROM A CONTRACT
|
- Purchaser – Consumer has the right to withdraw from the contract within:
- 2 hours from the submission of the form, sending Seller in an electronic way a proper statement with the following content: "I hereafter signed .................................. state that due to point VII.1. of the regulations withdraw from the order – sales contract no..... (include the number of the order), entered on .............." to the web address: sklep@maszty.com.pl (in subject include: "Withdrawal")
- 10 days from the date of the goods’ reception mentioned in point IV.3. of the regulations, sending Seller a written statement in accordance with the pattern described in point VII.3. of the regulations.
- Purchaser - Consumer is obliged to send the statement which is mentioned in point VII.1.B. by registered mail with a postscript "Withdrawal" to the address: ALUMAST joint stock company located in Wodzisław Śląski at ul. Marklowickiej 30a, 44-300 Wodzisław Śląski.
The deadline described in point VII.1.B. of the regulations is dependent on the post office stamp
- The pattern of the statement concerning the withdrawal:
"I hereafter signed .................................. state that due to point ..... of the regulations withdraw from the order – sales contract no ....., entered on ..............".

VIII. RETURNS
|
|
In case of contract withdrawal mentioned in point VII.1.B) of the regulations Purchaser is obliged to return the goods via the courier after prior confirmation with Seller.

IX. TECHNICAL CONDITIONS TO DEAL WITH INFORMATION SYSTEM
|
|
To deal with the ALUMAST online shop, Purchaser needs an Internet browser operating the SSL Protocol and has to have Cookie files on.
|
X. FINAL PROVISIONS
|
- Seller has the right to change the regulations.
- All the changes take effect after being announced at the internet page www.maszty.com.pl or alumast.com.pl.
- Changes in regulations do not concern the Forms which have successfully been submitted by Purchasers at www.maszty.com.pl or alumast.com.pl.
- In cases not standardized in the Form and hereby regulations the Civil Code is adopted.
- The hereby regulations are valid from 6th January 2006.
